These terms are the agreement between you and Framiq L.L.C., a New Mexico limited liability company ("Framiq", "we", "us"). They cover your use of the Framiq website, apps, and services (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. Who can use Framiq
You must be at least 18 years old. If you use Framiq for a company or other organization, you confirm you are allowed to accept these terms on its behalf, and "you" then means that organization.
Framiq is operated from the United States and is directed at customers in the United States. We do not market or target the Service to the European Union, the EEA, or the United Kingdom. You are responsible for following the laws that apply where you are.
2. Your account
Keep your login details safe and do not share your account. You are responsible for everything that happens under your account. Tell us at hello@framiq.art if you think someone else has access to it. The details you give us at sign-up need to be accurate, and you need to keep them current.
3. What Framiq does
Framiq lets you generate images and video with AI, organize them, and run them through brand and approval workflows. Generation runs on third-party AI models, including models hosted by fal.ai. When you generate something, your prompt and any images you upload are sent to those providers so they can produce the result. Our Privacy Policy explains how that data is handled.
4. Credits, plans, and payment
Generating content uses credits. You get credits through a subscription plan or by buying credit packs. The price of each plan and pack, and how many credits it includes, is shown at checkout before you pay.
Payments are handled by our reseller and Merchant of Record, Polar(Polar Software, Inc.). Polar processes the transaction, sends your receipt, and collects any sales tax or VAT that applies. Your purchase is also subject to Polar's terms. Prices are shown in the currency stated at checkout.
Subscriptions renew automatically. At checkout we tell you the price, the billing period, and when the next charge happens, and you agree to those terms before you pay. Your plan keeps renewing at the same price and interval until you cancel. If a price changes, we will tell you before the change takes effect.
You can cancel any time from your billing settings, or by emailing hello@framiq.art. Cancelling stops the next renewal. It does not refund the current period unless our Refund & Cancellation Policy says otherwise. Credits from a subscription are meant to be used during the period they are granted, and unused credits may expire as described on your plan.
5. Rules for using Framiq
You must follow our Acceptable Use Policy. It lists the content and behavior that are not allowed, such as content that sexualizes minors, non-consensual sexual imagery, deepfakes of real people made without their consent, and anything illegal. Breaking those rules can get your account suspended or closed. We may remove content or limit the Service to keep it safe and lawful, and to meet the rules our AI providers require us to pass on to you.
6. Your content and what you can do with generations
You keep whatever rights you have in the prompts and files you upload ("Input") and in the images and video you generate ("Output"). You are responsible for your Input, and for making sure you have the rights to use it, including any photos of people, logos, or copyrighted material.
As between you and us, you own your Output and can use it, including for commercial work, as long as you followed these terms and the Acceptable Use Policy when you made it. AI models can produce similar results for different users, so we cannot promise your Output is unique. Depending on where you live, AI-generated content may not qualify for copyright, and that is outside our control.
You give us permission to host, store, and process your Input and Output so we can run the Service for you, including sending Input to the AI providers that generate your results. You can delete your content, and closing your account removes it, subject to backups and any records we have to keep by law.
7. AI-generated content is not perfect
AI models can produce results that are wrong, biased, or that look real but are not. Check anything you plan to publish or rely on. You decide how to use your Output and you are responsible for that use, including telling your audience it was AI-generated when the law requires it.
8. Our intellectual property
Framiq, including the site, software, and branding, belongs to us. These terms do not give you any right to our name, logo, or code beyond using the Service as intended. Do not copy, resell, or reverse-engineer the Service, and do not use it to build a competing product or to train another AI model.
9. Copyright complaints
If you believe content on Framiq infringes your copyright, email us at hello@framiq.art with enough detail to identify the work and where it appears. We respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA) and may remove content or close accounts of repeat infringers.
10. Third-party services
Framiq works with other companies to run, including AI providers such as fal.ai, payment through Polar, storage, email, and hosting. Their services come with their own terms, and we are not responsible for them.
11. No warranty
The Service is provided "as is" and "as available". We do not promise it will always work without interruption or errors, and we do not warrant the accuracy, quality, or fitness of any Output. To the extent the law allows, we disclaim all warranties that are not written into these terms.
12. Limit on liability
To the extent the law allows, Framiq is not liable for indirect, incidental, or consequential damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose. Some places do not allow these limits, so parts of this section may not apply to you.
13. You cover claims from your use
You agree to cover us (and defend us if we ask) against claims, losses, and costs, including reasonable legal fees, that come from your Input, your Output, your use of the Service, or your breach of these terms or the Acceptable Use Policy.
14. Suspending or ending your access
You can stop using Framiq and close your account any time. We can suspend or close your account if you break these terms, if we are required to by law, or if keeping it open puts the Service or other people at risk. If we close your account without cause, we will refund any prepaid, unused amount as set out in the Refund Policy.
15. Governing law and disputes
These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. You and Framiq agree to resolve any dispute through binding individual arbitration rather than in court, and you both waive any right to a jury trial or to take part in a class action. You may opt out of arbitration by emailing us within 30 days of first accepting these terms. Nothing here stops either of us from seeking relief in a small-claims court where eligible.
16. Changes to these terms
We may update these terms as Framiq changes. If we make a significant change, we will let you know, for example by email or a notice in the app. If you keep using the Service after a change takes effect, that means you accept the new terms.
